Hawaiʻi tax debt needs Hawaiʻi experience

When DOTAX starts collecting, local knowledge matters.

A Hawaiʻi Department of Taxation problem is not simply a smaller IRS case. State payment plans, wage levies, appeals and settlement standards work differently. Kōkua Tax helps you understand what DOTAX can do, what deadlines still matter and which resolution is realistic.

A state case is its own case

Resolving the IRS does not automatically resolve Hawaiʻi.

Federal and state liabilities can involve different returns, balances, collection employees, appeal deadlines and payment arrangements. A solution that works with the IRS may be unavailable—or strategically wrong—for DOTAX.

“The correct first step depends on whether the problem is a missing return, a disputed assessment or an active collection case.”
01

Identify every account

We separate individual income tax, General Excise Tax, withholding, rental and other Hawaiʻi liabilities by period.

02

Find the real deadline

Proposed and final assessments have different appeal windows. Waiting can eliminate options.

03

Restore compliance

Required returns generally must be filed before a sustainable payment plan or compromise can move forward.

04

Build the right resolution

We compare payment, hardship, appeal and settlement paths instead of forcing every case into one program.

DOTAX collection power

Liens and levies can reach both people and businesses.

What DOTAX may do
  • File a state tax lien.
  • Levy bank accounts or other property.
  • Withhold 25% of an individual’s gross wages through a continuous wage levy.
  • Intercept state or federal tax refunds.
  • Refer a defaulted collection case to the Attorney General or a private collection agency.
What not to assume
  • An IRS agreement does not cover the state balance.
  • A partial payment does not automatically release a wage levy.
  • A new payment plan does not automatically stop an existing wage levy.
  • A hardship request succeeds without financial proof.

What DOTAX requires

All required returns must be filed, future returns and taxes must remain current, and the taxpayer cannot add new liabilities while the agreement is active.

Cost and continuing charges

DOTAX currently charges a nonrefundable $50 processing fee. Interest and applicable penalties continue until the balance is fully paid.

Plans longer than 12 installments

DOTAX may require Form CM-2 or CM-2B, three months of bank statements and other financial support.

Lien risk

DOTAX states that a state tax lien may be initiated for an installment agreement lasting more than one year, depending on the balance and other circumstances.

Default risk

A missed payment, late return or new liability can default the plan and expose the full balance to lien, levy, garnishment or referral.

Wage-levy reduction

DOTAX may reduce the 25% withholding when the levy creates significant financial hardship, such as being unable to afford food, rent or medication.

What must be submitted

A written request, Form CM-2 and proof such as bills, past-due notices and recent bank statements may be required.

A reduction is not a release

Hardship can support a lower withholding amount, but DOTAX identifies full payment or bankruptcy as the stated bases for releasing an individual wage levy.

Proposed assessment

An application to the Administrative Appeals and Dispute Resolution program generally must be filed within 20 calendar days after the proposed assessment is mailed.

Final assessment

The post-assessment application deadline is generally 30 calendar days after the final or preparer-penalty assessment is mailed.

No extension for a late application

DOTAX warns that late AADR applications will be rejected. The notice date and the type of assessment must be verified immediately.

An appeal needs a position

Kōkua organizes the return, records, legal issue and supporting explanation so the appeal addresses why the assessment should change—not merely why it is difficult to pay.

State offer in compromise

Possible does not mean broadly available.

DOTAX can settle qualifying debt for less than the total owed, but its published standards are narrow. Kōkua will assess eligibility before recommending an expensive or unrealistic application.

“Everyone with a large balance should apply.”DOTAX looks for limited assets, no significant passive income and an inability to generate future income because of retirement or qualifying health conditions.
“Filing an offer guarantees relief.”Meeting the basic requirements does not guarantee acceptance, and extensive financial verification is required.
“Old missing returns can be ignored.”Required returns must be filed through the current period.
“A federal settlement controls the state.”DOTAX conducts its own review under Hawaiʻi standards, although it may request the federal offer and acceptance letter.
